[CH]OFF: website refuses to credit my scans

A few months ago there was a thread about unauthorized use of chilehead
webpages within another site's frames. There were issues of copyright
violations brought up. I may have a case of this, too.

I have three scans on a website, "http://www.dynrec.com/elp/scenes2.html",
the Lucky Man story. Last August my credit, "Thanks to Karen E. Stober for
the 3 black and white scans ELP, on this page.", was at the bottom of the
page. By April my credit was removed. No explanation given and the manager
of the site says if I say anything he'll take legal action against me. I
told him he either puts my credit back or removes those scans, or I'll take
legal action against him. This morning I faxed the dated webpage printouts
to ELPs management hoping they can resolve this. Netscape date stamps each
page and I printed them off last August to proudly show friends who don't
have Internet access.

My question is, what legal action can I take against the manager of the
site? Would I file a restraining order & court injunction against him using
my scans? The only information I can find deals with court cases and
juries. Do I have to travel to where the site manager is, Rochester, NY,
or can I file the paperwork in New York City, where it can be done through
the mail. I live in New Jersey. Do I have to file a complaint with the
Better Business Bureau first?

Any help is greatly appreciated.

Yours in heat,
