This is not true, at least not for spearmint.  Spearmint will eventually
spread freely from any contact with the soil, including at least 12 inches
below ground surface.  I have no experience with mint planted such that its
only contact with soil is deeper than about 1 foot, however, so no opinion
about whether/how quickly it could spread from such a situation.

Note: those cute little mint flowers produce seeds which disperse and
readily sprout next Spring throughout your garden, too.
